If you are using Postaz on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Postaz is a social media scheduling and publishing platform that enables users and AI agents to schedule, manage, and publish content across social media platforms (such as TikTok, Instagram, and others). Postaz provides a unified API and web interface for these purposes.

3. Accounts

You must create an account to use Postaz. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Postaz immediately at [email protected] if you suspect unauthorized use of your account. Postaz is not liable for any loss or damage arising from your failure to protect your credentials.

4. Acceptable Use

You agree to use Postaz only for lawful purposes and in accordance with these Terms. You must not use Postaz to:

• Post or transmit content that is illegal, harmful, defamatory, or infringes the rights of others.
• Violate the terms of service of any connected social media platform.
• Attempt to gain unauthorized access to Postaz's systems or another user's account.
• Use automated means to access or scrape the Service in a manner that exceeds normal usage.
• Engage in spam, phishing, or any deceptive practices through content published via Postaz.

Postaz reserves the right to suspend or terminate your account if you violate these rules.

5. Subscriptions, Billing & Refunds

Postaz offers access to the Service through monthly and annual subscription plans. By subscribing, you authorize Postaz to charge your chosen payment method on a recurring basis for the selected plan.

• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds, either partial or full, are generally not available due to the nature of the Service. If you believe you were charged in error, contact us within 14 days.
• Postaz reserves the right to change pricing, plan features, and access restrictions at any time, with notice provided via email or the Service.

6. Your Content

You retain ownership of all content you create and publish through Postaz. By using the Service, you grant Postaz a limited, non-exclusive license to store and process your content solely for the purpose of providing the Service to you. Postaz does not claim ownership of your content and will not use it for any other purpose.

You are solely responsible for the content you publish through Postaz and must ensure it complies with all applicable laws and third-party platform policies.

7. Third-Party Integrations

Postaz integrates with third-party social media platforms (such as TikTok) to provide its publishing features. Your use of those platforms is governed by their respective terms of service and privacy policies. Postaz is not responsible for the actions, content, or policies of third-party platforms.

8. Intellectual Property

All rights, title, and interest in and to Postaz — including the website, platform, API, software, logos, and trademarks — are and remain the exclusive property of Postaz. Nothing in these Terms grants you any right to use the Postaz name, logo, or branding without our prior written consent.

9. Disclaimers

Postaz is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Postaz does not guarantee that the Service will be uninterrupted, error-free, or that content published through the Service will be accepted by third-party platforms.

10. Limitation of Liability

To the maximum extent permitted by law, Postaz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if Postaz has been advised of the possibility of such damages. Postaz's total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to Postaz in the 12 months preceding the claim.

11. Termination

Postaz may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use Postaz ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimer, limitation of liability) will survive.

12. Communications

Postaz may send you emails related to your account, billing, security, and the Service. We may also send optional marketing communications about Postaz features and updates. You can unsubscribe from marketing emails at any time via the unsubscribe link in any email or by contacting us.

13. Modifications to Terms

Postaz reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the revised Terms on postaz.app and updating the “Last updated” date. Your continued use of Postaz after the effective date of the revised Terms constitutes your acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
